The special MCOCA court on Tuesday reserved its order on an intervention application filed by a man whose son had died in 2008 Malegaon bomb blast.

Syed Nisar Ahmed filed intervention application through advocate Khan Abdul Wahab. Mr Khan contended before the court that the applicant lost his son in the blast and he is an aggrieved party in this case and hence his application should be allowed.

On the other hand, NIA prosecutor Avinash Rasal opposed the application saying that even if applicant’s son lost his life in the blast, the applicant does not have any first hand knowledge about the incident and he cannot bring any new fact before the court and hence does not have a locus in the matter.

He further added that the prosecution in the case is relying upon the chargesheet filed by the NIA and its case is based on evidence collected by the agency so there is no need for a third party to intervene in the matter.

However special judge Shripad Tekale said that there are high court and Supreme Court judgements, which cast upon the duty on the judge to decide on intervention application and reserved the order till Wednesday.

The court is currently hearing bail application filed by Sadhvi Pragya Singh Thakur and four others who have been given clean chit by the NIA in its chargesheet. According to NIA, there is no evidence to prove that these persons were involved in the blast.
