The Bombay high court on Saturday told the Central Bureau of Investigation (CBI) that if it wants to rely on certain documents while opposing the bail application filed by former media baron Peter Mukerjea it would be required to show it to the defence, and otherwise it cannot rely on it. The court also asked prosecution to inform the court on the next date of hearing if it is ready to show these documents to defence or it would not rely on them.

Justice A.S. Gadkari was hearing the bail application filed by Peter Mukerjea in the Sheena Bora murder case. Replying on the same, additional solicitor general (ASG) Anil Singh on behalf of CBI opposed the bail application. He also produced the case diary and related documents for the court’s inspection, but said it could not show them to the defence as the investigation was still on.

Justice Gadkari, however, said this was not right because the agency was relying on these documents for opposing the bail, so they must be shown to Peter’s lawyers.

The judge while adjourning the matter for two weeks asked the ASG to inform the court on the next date of hearing if the CBI is ready to show the documents to Peter’s lawyer, or whether the agency would not rely on them.
