A day after Supreme Court dismissed the petition to stall the action, Brihanmumbai Municipal Corporation (BMC) demolished the illegal structure of a popular food joint ‘Mumbai Tawa’ at Andheri (west) on Saturday.

According to the civic officials, the illegal stall of an eatery had been constructed on the footpath of Link Road, near Esic Nagar. The stall bearing licence number 1447 was issued to late Kishore K. Shah for selling Mafco products. For infringement of licence terms and conditions, senior inspector (licence) issued an inspection report and show cause notice to the current licence holder. The party challenged it in the city civil court, which granted ad-interim relief to them.

The K/West ward office again carried out the inspection and issued another show cause notice to the party. The civic civil court dismissed the suit and granted 15 days leave to the party.Meanwhile, the party appealed in the high court, but the court dismissed the plea on October 17 and two weeks’ status quo was granted to the party. Finally, the party moved the Supreme Court, which too dismissed the petition on October 30.Accordingly, the demolition drive was carried out by the K/West officials, in which the illegal stall of the food joint was razed down.

Parag Masurkar, assistant municipal commissioner of the K/West ward, said, “The license holder was allotted a Mafco stall, however Mumbai Tawa was misusing it for cooking purposes. It was also found that the license did not belong to them. It was a long legal battle, in which we had to fight in civil, high and Supreme Court. As the Supreme Court dismissed their petition on Friday, we immediately took the action and demolished the illegal stall of the eatery.”
