Lawyers representing Chhagan Bhujbal in his application for a medical bail presented their arguments in the Bombay high court on Tuesday. They cited many anomalies in the medical reports submitted by JJ Hospital and questioned the genuineness of the same.

Senior counsel Amit Desai, on behalf of Bhujbal, disputed the genuineness of the medical report submitted by JJ Hospital on the basis of information received under RTI from Arthur Road jail. According to the report, the first ECG was taken at 9:42:55 in the morning on May 24, 2016. As per the RTI reply though, Bhujbal left the Arthur Road prison at 9.50 am the same day and hence it was not possible for authorities to conduct medical test on him at the time mentioned in the report.

Advocate Desai further claimed that though other two ECG reports are computer generated but only the patients name is hand written in all of them and this puts the ingenuity of these reports in question said the lawyer.

Another major anomaly pointed out by the applicant’s lawyer was that one computer generated report had the date August 8, 2008 and asked the state how was it possible that Bhujbal was admitted in May 2016 and his report was ready in August 2008.

Bhujbal’s lawyer also contended that the state’s doctor had not shown concern towards his client as they had only termed him as clinically stable and had not cared for his physical stability. He said that the doctors by stating him clinically stable helped the government to keep Bhujbal in judicial custody.

He informed the court that when Bhujbal’s family approached the doctors at Hinduja Hospital in Khar for a second opinion, the doctors pointed out that given the patient’s old age (69) and the fact that he has had a heart attack in 2003 he was in the risk zone for another one, unless further tests and if necessary an angioplasty or bypass is performed. The counsel requested the court to grant the applicant a medical bail so that he can get the tests done as recommended by the doctors at Hinduja Hospital. The arguments will continue on Thursday.
