Advocate Moin Khan who has alleged that police at Vakola police station beat him up on Sunday is gearing up to file a private complaint at a magistrate court saying police is not filing the FIR on his complaint. He has also written letters about the incident to human rights commission, home department, high-ranking police officers and advocate’s bar association.

“We have requested police authorities to preserve the CCTV footage of the Vakola police station because everything must have been recorded in them,” said advocate Khan.

The police has also alleged that it was Khan who abused the policemen at the police station. However, the lawyer has denied the charge, “Why would I or any lawyer will go to police station and start abusing police I have heard that police has claimed that I started abusing them, but facts could be seen in CCTV recording.”

Advocate Khan has claimed that the policemen dragged him to detection room where he was abused in filthy language, assaulted and was called a terrorist.

According to the lawyer, this incident has a connection with another case. He said that some time ago, Vakola police had called up one of his clients, Ejaz Khan, for questioning in connection with buying of stolen gold. Ejaz informed police that one of his friends had kept this jewellery with him but he was not aware about any crime and handed over all the gold to police. But even after giving up all the gold, Ejaz was allegedly tortured by the police. He informed advocate Khan about this ill treatment at the hands of police when he was produced in the court. The magistrate had then sent Ejaz for medical test and on the basis of the medical report, which had corroborated with the allegations, the magistrate had directed to file an FIR against the police officers responsible.

Advocate Khan claimed that when he went to give out the magistrate’s order, which had directions of registering a complaint against policemen, they did not want to receive the order copy initially and after signing it the police officer flung the document on Mr Khan’s face and abused him.

DCP Virendra Mishra of zone VIII under whose jurisdiction this police station comes, said, “An FIR under section 353 (Assault or criminal force to deter public servant from discharging of his duty) and 332 (Voluntarily causing hurt to deter public servant from his duty) of IPC is registered against advocate Khan after an inquiry and the investigation is going on in the matter.”
