Dabholkar murder: CBI seeks custody of Kalaskar

Mumbai: The Central Bureau of Investigation (CBI) has moved an application before special UAPA court judge Samir Adkar to seek a transit remand of accused Sharad Kalaskar.  The CBI counsel argued that Sachin Andure has been arrested in the killing of slain activist Narendra Dabholkar, who is now in the custody of the CBI. He also argued that Sharad Kalaskar is also involved in the Dabholkar murder and is allegedly the shooter in the case.

The CBI also argued that the Bombay HC is monitoring the Dabholkar case and the CBI has been putting forth its progress reports.

ATS counsel Sunil Gonsalves informed the court that the ATS has no objection if the CBI takes Kalaskar into custody, but after the CBI custody gets over the ATS should get his custody immediately.

Defence counsel Sanjiv Punalikar objected to the CBI custody and argued that the CBI had only alleged that UAPA has been slapped against the accused and they have been arrested under sections of the IPC so an ATS custody is important than CBI custody.

Judge Adkar told the CBI that eight days of custody has already been granted to the accused, however, the he wondered if  it would be legal to remand Kalaskar in custody in a UAPA court in a murder case. The court kept the next hearing for Wednesday.

The CBI has arrested Dr. Virendra Tawade of Sanatan Sanstha in the killing of Dabholkar. The CBI is trying to trace the motorcycle used in the offence by alleged arrested shooter Sachin Andhure and Sharad Kalaskar. Andure has been remanded in CBI custody till August 30 by a Pune magistrate’s court.
