New Delhi: In a first such case after the Supreme Courtâs landmark verdict of decriminalising homosexuality, a 25-year-old woman has alleged that a 19-year-old girl sexually assaulted her using a sex toy and also subjected her to continuous cruelty.
The victim, even after repeated attempts, failed to lodge a police complaint against the accused woman.
According to information, the victim, who hails from eastern India, had come to Delhi for work. She has alleged that the 19-year-old accused raped her and subjected her to repeated sexual and physical assaults. The nightmare didnât end there for her. She went to Seemapuri police station in Delhi, but cops refused to book the accused.
âI had requested the police at the Seemapuri police station to charge her. But they refused to lodge the complaint. They even asked me not to mention it to the magistrate, but I did,â the complainant alleged.
On September 26, a magistrate at the Karkardooma district court recorded the victimâs statement under Section 164 of the CrPC (Code of Criminal Procedure).
The incident started to unfold in March when she quit her job to invest in her own business. Later, she got into an agreement wherein she was required to get other partners to invest in an online clothing merchandise. When she began searching for partners, she met the other accused, Rohit, and the girl, who told her that they were ready to invest.
DCP (Shahdara) Meghna Yadav said that based on the original complaint of the victim, an FIR was registered under Section 376D of the IPC. Following this, one of the accused has been arrested.
âThe FIR complaint given by the lady does not mention any woman accused. In her police statement she has alleged a woman. Necessary sections have been added and action has been initiated,â the DCP added.
The victim alleged that Rohit later took her to Dilshad Colony, where he introduced her to another accused, Rahul. They both raped her and shot obscene videos.
The victim further alleged, âFirst they forced me to have sex with them. Then it became a gang affair. Soon, I was sent to serve clients and the accused woman was always there in the apartment. She often tried to get close to me. Whenever I refused, she used to beat me.â
The victim also added that Rohit and Rahul pinned her down on all fours on the bed while the accused woman ârapedâ her using a sex toy and sodomised her to make her ready for customers.
During this period, the victim was allowed to contact her parents but was threatened against revealing anything. Her parents received Rs 20,000 in their account directly from Rahul as âfees,â which her parents assumed was her business profits.
Another accused, Sagar, allegedly aided the victimâs confinement. Rahul and Rohit have been booked under sections of rape, illegal confinement, and under sections of the Immoral Trafficking Prevention Act. Sagar has neither been charged with rape nor attempt to rape.
The police arrested Rahul, who has been sent to Tihar jail. However, Rohit is still at large.
The victim has told the court that she is 6-week pregnant and has sought permission for an abortion.
