Though the Delhi high court on Thursday set aside the AAP government’s order appointing 21 MLAs as parliamentary secretaries, it is yet to be ascertained whether the legislators held the office of profit for their disqualification from the Delhi Legislative Assembly.

Experts said that the Election Commission, which is hearing the matter of the 21 Aam Aadmi Party MLAs, will take a call on whether the legislators hold the office of profit on the petition filed by Prashant Patel.

The petitioner had claimed the post of parliamentary secretary comes under the “office of profit”.

Sanjay Kumar, a constitutional expert with CSDS, said that the final call on the matter will be taken by the poll body, the proceedings for which are in progress.

The AAP government had appointed 21 parliamentary secretaries to assist its ministers.
