Police oppose review plea of convict in Supreme Court

New Delhi: The Supreme Court on Tuesday reserved verdict on plea of Mukesh — one of the four death row convicts in the December 16, 2012 gangrape and murder case — for review of its order upholding the capital punishment awarded to him.

The Delhi police has opposed the plea filed by Mukesh.

The police told a three-judge bench of Chief Justice Dipak Misra and Justices R. Banumathi and Ashok Bhushan that submissions advanced by the counsel appearing for convict Mukesh does not make out a case for review of the apex court’s judgement.

In May this year, the apex court had upheld the death penalty to the four convicts — Mukesh (29), Pawan (22), Vinay Sharma (23) and Akshay Kumar Singh (31) — saying the “brutal, barbaric and diabolic nature” of the crime could create a “tsunami of shock” to destroy a civilised society.

Later on a review petition filed by the four convicts, the apex court had stayed their execution. While one juvenile completed his three years sentence in a juvenile home, another accused Ram Singh had committed suicide in Tihar Jail.

The bench reserved verdict on review plea in so far as Mukesh was concerned and in respect of three others, the bench posted the matter for further hearing on January 22, 2018.

Counsel M.L. Sharma, appearing for Mukesh urged the court to review the verdict, as the trial court did not properly consider the evidence.

The CJI made it clear to the counsel that the court cannot appreciate fresh arguments on evidence as all the arguments were considered while pronouncing the verdict. The bench however reserved verdict on the review petition.
