‘Book Vakola cops, probe advocate’s complaint’
A magistrate court in Bandra on Friday asked a “competent police officer” to register an FIR against police officials of the Vakola police station and inquire into complaint of advocate Moin Khan in which he has alleged that he was abused, assaulted and '25,000 in cash was forcefully taken from his pocket.
Advocate Yusuf Khan, while arguing on behalf of Moin Khan, narrated the whole incident to the Bandra magistrate and requested the court to decide the application on an urgent basis because there is apprehension that the police could influence witnesses of the case and also destroy or tamper with CCTV footage available at the Vakola police station, which could be an important piece of evidence.
It was argued before the court that as per Supreme Court guidelines in the Lalita Kumari case, it is the duty of the police to register an FIR if somebody comes with a complaint about assault, robbery, and illegal detention. But in this case, the police did not take Moin Khan’s complaint. In fact, an FIR was registered against him under Sections 353 (Assault or criminal force to deter public servant from discharging of his duty) and 332 (Voluntarily causing hurt to deter public servant from his duty) of the IPC to save the police officers.
According to Yusuf Khan, after hearing arguments the magistrate passed order and said that the application has been accepted and a competent officer has been directed to register an FIR. “We will come to know which officer has been asked to register the complaint once we get the copy of order,” said Yusuf Khan. “We do not have any information (about such order), said DCP Virendra Mishra of zone VIII under whose jurisdiction this police station comes.
Moin Khan alleged that he was abused and assaulted by the Vakola police when he had gone to the police station to serve a copy of a court order that was against the police officers.
