Tadvi murder: Bombay HC rejects bail plea of three doctors
The judge also noted that the allegations made in the FIR clearly disclose the offence under which crime is registered.
Mumbai: A sessions court on Monday rejected the bail application filed by three doctors arrested in connection with the suicide of Dr Payal Tadvi.
Special judge P.B. Jadhav, while rejecting the bail pleas of all the three doctors Hema Ahuja, Bhakti Mehare and Ankita Khandelwal, observed that there is possibility that if released on bail the accused would tamper with evidence or abscond and will not be available for the trial.
The judge also noted that the allegations made in the FIR clearly disclose the offence under which crime is registered. “I have also gone through the case diary. There is material to support most of the allegations made in the FIR. The investigation is in progress,” judge Jadhav said.
The judge also took note of arguments of special public prosecutor Raja Thakre and advocate Gunratan Sadavarte, who appeared on behalf of Dr Tadvi’s mother Abeda that after the suicide, the applicants reached the room; they removed the dead body and moved it to the trauma room.
“The available CCTV footage show that after moving the body to the trauma room, the applicants went to the room of the victim. They did not explain the reason behind this. Therefore, it cannot be denied that they tried to search the evidence against them in the said room. It is unclear whether they found any evidence and if yes, what has happened with that evidence. But it can be said that their behaviour was towards that direction,” observed the judge.
The judge noted points put forward by advocate Sadavarte in which he has claimed that earlier the accused created ruckus in the court premises and had also allegedly threatened mother and husband of Dr Payal Tadvi.
“The investigation is in progress. Their release would affect the investigation adversely. Therefore, at this stage, it would not be a wise decision to release them on bail,” said the judge.
The accused have been booked under relevant sections of the Indian Penal Code and under the Maharashtra Prohibition of Ragging Act.
