Bombay HC to decide bail pleas of 3 accused sans e-evidence

All the accused said that they had no objection if their bail applications were heard without providing them copies of electronic evidence.

Mumbai: The Bombay high court has directed a special Pune court to decide the bail applications of the three accused in the Bhima-Koregaon violence case without providing them copies of electronic evidence such as laptop data and DVDs that were seized by the police during house searches of the accused.

A single bench of Justice Sambhaji Shinde was hearing the bail pleas filed by the three accused in the case - Sudhir Dhawale, Surendra Gadling and Dr Shoma Sen.

According to them, one of the accused had filed an application before a special Pune court seeking copies of electronic evidence but the special court judge refused to hear it unless and until the accused was provided copies of electronic evidence.

On Wednesday, all the accused said that they had no objection if their bail applications were heard without providing them copies of electronic evidence.

The applicants’ counsel Mihir Desai told the court that more time was required to receive clone copies of electronic evidence and that there was a procedure, too, which needed to be followed by the applicants, police and court staff while cloning the evidence.

Additional public prosecutor (APP) Aruna Pai informed the court, “We have filed the charge sheet and then, the supplementary charge sheet, and hard copies of electronic evidence are attached to the charge sheet. If they (the accused) want, they can rely on them otherwise providing clone copies will take time.”
