Disposal of cases related to property to be easier

The system will not only help judicial officers to speed up the process of handling such applications, but will also provide a major relief to those whose properties have been seized in different cases.

Following an order issued by Saket district and sessions judge Brijesh Sethi that single window system should be followed for disposal of case properties, Delhi police commissioner B.S. Bassi directed that the same be followed in principle by each police district across the city.

Mr Sethi said that all such applications filed at the facilitation centre should be put up before the district and sessions judge in connection with cases which are pending before the sessions court and the chief metropolitan magistrate for matters under consideration of the magisterial courts. The judge, however, made it clear that the applications should be put up before the district judge and the CMM on the very next day of filing of the same. He said that a separate register should also be maintained for noting down the relevant details at the facilitation centre and in the magistrate’s office.

The judge said that all such applications should be accompanied by an undertaking from the police that no appeal was pending in the matters filed either by the state or by the accused. He noted that in the cases where investigation is pending, the particulars of the investigation officer should be clearly mentioned in the application.

Mr Sethi said that the applications should be filed in a set format and they should be verified by the station house officer of the concerned police station and forwarded by the assistant/ additional public prosecutor of the concerned court or by the chief public prosecutor. He said that the police should only move one application for each FIR irrespective of the number of articles which are to be disposed of in the matter.

The judge said in case more than one application was filed by one police station on a single day, all such applications should be bunched together and accompanied by an index.
