Binoy moves HC against rape FIR

Mumbai: Binoy Kodiyeri, son of Kerala state secretary of the CPI (M) Kodiyeri Balakrishnan, has filed a petition in the Bombay high court seeking to quash the rape FIR lodged against him in Mumbai. The petition will come up for hearing this week.

“Yes, Binoy Kodiyeri has approached the HC seeking to quash the FIR filed against him. He has filed the petition on various grounds and we are party in the petition,” said Abbas Mukhtiar, lawyer of the complainant.

Binoy Kodiyeri has filed the petition after a local court, on July 3, granted him pre-arrest bail in the case. Following the court order, he moved the HC last week seeking to quash the case against him. According to him, he has been falsely implicated in the case.

The petition is expected to come up for hearing before a division bench of Justice Ranjit More and Justice Bharati Dangre on July 24.

A 33-year-old woman has filed a case of rape against Binoy Kodiyeri on June 13, after she allegedly found out that the accused was already married. The woman, who is a native of Bihar, alleged that the accused exploited her for years together and later left her with their child. In her complaint, she has claimed that they first met at a dance bar in Dubai in 2008. The complainant has allegedly also given some pictorial evidence to the police, supporting her claims. She has claimed that a child was born out of their relationship.
