A local magistrate court in Mumbai on Monday reserved order till June 1 on the Mumbai police’s special investigating team’s application seeking to issue a non-bailable warrant (NBW) against five policemen of the Haryana police who killed Sandeep Gadoli, a criminal, in a fake encounter.

The investigating officer of Sandeep Gadoli’s encounter had approached the court in the morning seeking issuance of NBW; however, the judge asked him to produce a copy of the FIR before his application could be heard.

During the hearing on this application, advocate Tanveer Nizam, on behalf of Gadoli’s brother Kuldeep Singh, argued that the SIT had amended the FIR and now complainant Pradyuman Yadav of Gurgaon crime branch unit-4 was termed one of the accused and the deceased, who was the accused, has become the victim so instead of doing this the SIT should have registered a fresh FIR.

Though Mr Nizam supported the SIT’s application for issuance of NBW against the accused policemen, he said that it is a general practice that police uses its power to arrest the accused after registering murder case, but in this case the investigating officer had come before the court seeking a NBW, which was not necessary.

He also pointed out to court that it is its admitted position that eight men had travelled to Mumbai but SIT had registered a case against five persons.
