Nagpur top cop pulled up for illegal detention

Mumbai: The Nagpur bench of the Bombay high court has rapped the Nagpur police commissioner for illegally detaining an accused in a case related to the Maharashtra prevention of dangerous activities of slum lords, bootleggers, drug offenders, dangerous person and video pirates act, without any evidence. The court observed that the detention seemed to be intentional and hence ordered the accused to be released.

A division bench of Justices B.P. Dharmadhikari and V.M. Deshpande were hearing a writ petition filed by Anil Manglani challenging the detention order of the commissioner.

The petition claimed that the two offences based on which he was detained were irrelevant and seemed fabricated. The petition also stated that in-camera statements were not verified and the detention order was passed mechanically without understanding the case.

The additional public prosecutor, however, informed the court that the contentions of petitioner were erroneous.

The court relied upon the documents submitted by the police, which enumerated the process of registering the two offences, taking in-camera statements, getting them verified, translated and endorsed by the relevant authorities.
