Woman, who killed lover in ‘self-defence’, gets bail
Deceased tried to rape the woman, says lawyer.
Mumbai: The Bombay high court has granted bail to a woman, facing murder charges, who told the court that she attacked the deceased in self-defence.
The woman, who was the employer of the deceased, had killed him by assaulting on his private part with sharp weapon after he refused to marry her. The woman’s lawyer told the court that the deceased had refused to marry her and tried to rape her following which she attacked him in self-defence.
While granting bail to the applicant Justice Prakash D. Naik accepted the contention of the applicant’s lawyers Owais Siddiqui and Atique-ur-Rehman that, “Assuming the case of the prosecution to be true, the defence of the applicant appearing from the memorandum of the statement reflected that the applicant has exercised right of private defence and resorted to the alleged act.”
The prosecution case is that the applicant is a resident of Bengaluru. She was residing there with her husband who used to run a cycle shop. The accused and deceased Kabir Ahmad Laskar (25) fell in love when he was working at the cycle shop. Later, Kabir shifted to Mumbai in search of a good job and also called the accused there.
After reaching Mumbai, on March 18, 2018, the applicant demanded Kabir to marry her, which he refused. Due to dispute amongst them the applicant assaulted Kabir with a knife on his private part and also strangulated him. The incident happened in a room rented by Kabir. The room owner filed a complaint when he noticed the broken lock of the room and water overflowing from the said room for two days.
Advocate Siddiqui on behalf of the applicant had contended that even if the statement of accused is seen as she has stated that she asked Kabir to marry her but he refused. Despite refusal for marriage he wanted a physical relationship, which she refused. The deceased then tried to force himself on applicant due to which she attacked him in self-defence that resulted in his death.
The defence had further contended that the probe in the case is over. The applicant is in custody since March 21, 2018.
