2012 Delhi gangrape case: SC declines DCW appeal for urgent hearing against juvenile's release

There is no stay on the juvenile convict's release, as Supreme Court has not given an urgent hearing. Delhi Commission for Women's SLP against the release of juvenile convict in the December 16 gangrape case will be heard on Monday by Supreme Court, says Swati Maliwal.

Maliwal and DCW lawyers said the matter has become sub judice and hoped that the government and Delhi Police will not release the juvenile offender.

Delhi Commission for Women had earlier filed a Special Leave Petition in the Supreme Court against the scheduled release of the December 16 gangrape juvenile convict, who has already been moved out of Delhi. “DCW filing Special Leave Petition in SC tonight. Will go to Judge's house, will try get hearing tonight against Nirbhaya convict's release,” Swati Maliwal, the body's chief, tweeted.

The convict is scheduled to released on Sunday. The development comes on a day the victim's parents were detained and later released after they held a protest against allowing the juvenile convict to walk free.

The convict, who is now 20 years old, has been taken to an undisclosed location from a correction home in North Delhi amid concerns that there was threat to his life. Ms. Maliwal earlier said that she was trying to move the apex court and that the registrar of the court has “called for the papers.”

"Trying to move Supreme Court tonight in Nirbhaya's case. Registrar of the court presently has called for the papers," she tweeted. “Will be waiting for justice outside CJI home. This is matter of not one Nirbhaya but of all Nirbhaya’s of the country,” she added.
