Lawyers warn of strike against AAP MLA arrest

Lawyers of Dwarka Court Bar Association (DCBA) have threatened to go on a strike on Tuesday to protest the arrest of AAP MLA Naresh Yadav in connection with the alleged Malerkotla sacrilege incident on June 24.

In a letter to DCP southwest, the lawyers’ body said the arrest was “arbitrary” and “highly condemnable”.

“The Punjab police arrested our member in a false Quran desecration case though he has joined the investigation thrice ...This act of police who were working under the dictate of the Punjab government is highly condemnable,” DCBA president B.S. Jakhar said in the letter, adding the Punjab police was trying to “terrorise” an advocate.

“As the detainee is a founder member of DCBA having his chamber at Dwarka courts’ chamber block, the coordination committee unanimously decided to register its protest by calling a complete strike tomorrow in all district courts in Delhi,” the letter said.

Mr Yadav was arrested by Punjab Police yesterday from his residence in Delhi under relevant Sections of IPC after one of the accused, Vijay Kumar, arrested in connection with the incident, claimed he had committed the crime at the behest of the MLA.

He has been charged with IPC Sections 109 (punishment for abetment if the act abetted is committed in consequence and where no express provision is made for its punishment), 153A (promoting enmity between different groups on grounds of religion, race, place of birth etc. and doing acts prejudicial to maintenance of harmony), 295 (injury or defiling place of worship with an intent to insult the religion of any class).

Mr Yadav before his arrest had described the police action against him as a “conspiracy”.

The police had claimed that Vijay had met the MLA before the incident and calls were also exchanged between them.
