A Delhi court on Wednesday said it would next week hear the bail plea of sacked Delhi minister Sandeep Kumar, who was arrested on rape charges.

Special judge Poonam Chaudhry, who was scheduled to hear the application on Wednesday, fixed the hearing for November 3 due to the absence of the investigating officer.

Mr Kumar sought the relief saying he has been in custody for nearly two months and investigation in the case was also over. Advocate Nitin Ahlawat, who filed the plea on behalf of the MLA, said his client should be released from jail so that he can celebrate Diwali with his family.

The counsel said the MLA’s conduct since the lodging of FIR was good and “unquestionable” and he had himself surrender-ed before the police. He also said the case was based on a CD which cannot be tampered with. Mr Kumar, who was arrested on September 3, is currently in judicial custody. The court had earlier allowed his plea to be produced through video conferencing.
